Lease Deed Registration Tamil Nadu — Process, Stamp Duty & Documents 2026

A lease deed (குத்தகை பட்டயம் — Kuthakai Pattayam) is a formal agreement between a landlord (kudiyiruppu kottupavar) and a tenant that grants the right to use property for a specified period in exchange for rent. In Tamil Nadu, lease deeds above 12 months must be registered to be legally enforceable — a verbal or unregistered lease for more than a year is not valid as evidence in court.

Many landlords and tenants skip registration to avoid stamp duty, which is a significant risk. In a dispute, an unregistered lease above 12 months cannot be admitted as evidence of tenancy terms.

Most residential rental agreements in Tamil Nadu are drafted for 11 months specifically to avoid the mandatory registration threshold. Legally, this is permitted — an 11-month agreement can be renewed repeatedly without registration. However, tenants and landlords lose the evidentiary protections that come with a registered deed.

Registration Process

Step 1 — Draft the Lease Deed

The lease deed should specify: the property address and description, lease start and end dates, monthly rent amount, advance/deposit amount, renewal terms, permitted use, and responsibilities of each party. Both parties should review and agree before proceeding to TNREGINET.

Step 2 — Create Document on TNREGINET

Log in at tnreginet.gov.in, go to Registration → Create Document → Lease Deed, and enter the required details. The portal calculates the applicable stamp duty.

Step 3 — Pay Stamp Duty and Registration Fee

Pay online. Print the payment receipt for the SRO visit.

Step 4 — Book SRO Token and Visit

Book an SRO appointment. Both landlord and tenant must appear in person with original documents and two witnesses. The SRO completes registration on the day of the appointment in most cases.

Frequently Asked Questions

Can an 11-month agreement be used for more than 11 months?
An 11-month agreement can be renewed repeatedly. Each renewal should ideally be documented in writing. However, if the total stay exceeds what the agreement covers without renewal documentation, disputes can arise over the actual terms.

Who pays stamp duty — landlord or tenant?
By convention in Tamil Nadu, stamp duty on a lease deed is paid by the tenant. However, this is negotiable between parties and should be specified in the agreement itself.

Can a lease deed be registered after the lease has started?
Yes, but with a penalty for delayed registration. Registration should ideally happen before or at the start of the lease. Delays beyond 4 months from execution attract a penalty calculated on the duty amount.

All registration steps described in this guide are completed on the official Tamil Nadu government portal.
